Please read these terms and conditions carefully before posting details of a proposed journey if you are a customer or, before you log in and bid if you are a taxi or minicab operator.
If you do not wish to be bound by these terms and conditions then you are unable to use our services
In these terms and conditions the following applies;
‘Company’ refers to Ecabs4u Ltd who own the website ecabs4u.com and associated mobile phone apps. Ecabs4u Ltd is a Private Limited company registration number 08721572 in England.
‘Cabby’ refers to any Hackney Carriage (taxi) licensed driver or any Private Hire (minicab) licensed driver who has been registered on the ecabs4u.com application by an approved operator.
‘Cab’ refers to any vehicle that is licensed as a Hackney Carriage (otherwise known as a taxi) and any Licensed Private Hire vehicle (otherwise known as a minicab).
Operators when registering a Cabby on this system do so in the knowledge that they are authorising the cabby to act on their behalf in relation to bidding for, negotiating and carrying out private hire jobs and that the cabby is in effect acting as his/her agent as well as an authorised driver who is licensed by your local authority.
Our company operates a website accessed via the internet with the URL of http://www.ecabs4u.com We also provide associated mobile phone apps that interact with our website and other websites (e.g. Google maps & Gocardless). We provide a market place on the internet for registered hackney carriage (taxis) & private hire operators (minicabs) to offer their services to the general public. The general public are able to post details of the journeys they wish to make and the facilities they require. Cabby’s are then able to post bids for those journeys. Once a bid is accepted by the customer and the cabby has acknowledged they will carry out the transfer, the cabby is provided with the customer’s contact details and the customer is supplied with the cabby’s contact details. At this time the driver will pay commission direct to ecabs4u Ltd. Customers should be aware that they may be liable to refund these costs should they cancel. This is at the drivers discretion.
All parties using company services must be aware that we are providing an introduction service. Once contact details have been exchanged we bear no responsibility for the conduct of the cab transfer. All facets of the operation and any disputes arising are between the customer and the driver and or cab company. Commission is paid by drivers to Ecabs4u Ltd. This is currently set at £1.00 for each successful bid. These payments are purely for the introduction and are not refundable.
Ecabs4u ltd reserves the right to alter these payments and conditions at any time with due notice by email.
The company accepts no responsibility for any loss occasioned as a result of reliance upon any of the contents and makes no warranty as to the accuracy of any said information supplied by the application whether via the website, mobile phone apps or other websites and applications used by the system that are not in the control of the company.
The company do not accept payments from the public. All payments are made directly with the driver.
By engaging with the companies application by website or mobile app actively as a customer or cabby you agree to be legally bound by these terms and conditions. After a bid is accepted on our website you will both be entering into a contract together and you will be bound by the terms and conditions of the taxi/minicab company. If a transfer is to be carried out and there are any changes to the journey details it is the customers responsibility to contact the driver and notify him of these changes directly. The company is in no way responsible for negotiating any charges customers may incur if they fail to comply with these conditions.
All jobs booked through the ecabs4u.com system are on a fixed price basis. The cabby agrees that he will adhere to the price quoted, which includes tolls, parking and any credit card surcharges that may have been incurred. Additional charges that may be levied are for excessive delay at the pickup point caused by the customers unpunctuality and not as a result of delay outside the control of the passenger. i.e. Aircraft, ship and train delays. Ecabs4u believe that these currently should not exceed £2 for each period of 5 minutes or part thereof and would not be levied unless the customer is more than 5 minutes late. These charges must be explained by the driver prior to commencement of the journey.
We require all our registered taxi and minicab companies to provide a top quality level of service. We have put in place a rating system which encourages drivers to maintain a very high standard. However, these ratings reflect previous customers opinions and we take no responsibility for their accuracy.
The company requires all registered operators to ensure that their cabby’s licences are kept valid and up to date. Upon registration operators are required to supply photographic evidence of the drivers taxi/private hire driving licence and a photograph of the driver. It is also part of company requirements that vehicles are roadworthy, taxed, licensed and insured. Operators are required to provide photographic evidence of the vehicles licence plate and a photograph of the car. These documents are kept up to date on our server. If any of these licences have expired the cabby is not able to bid for work. The company is not responsible for ensuring that the vehicle and driver are fully licensed on the date a customer wishes to travel as these are matters beyond our direct control. It is the customers responsibility to check these licences are displayed and in date before commencing their journey. If they discover that any of these requirements are not complied with in a particular case, they should alert us immediately by email.
We accept responsibility for death, injury or illness caused by the negligence of our employees whilst acting within the scope of or in the course of their employment. Please note however that we will not be liable for any injury, illness or death or consequent losses suffered by anybody or any member of their party where such injury, illness or death was not caused by lack of reasonable care or skill on our part. We will only pay damages that are applicable under English law.
In particular the company will not be liable to anybody for any loss caused by any failure of our server, the Internet, or other technical problem where such failure is occasioned by any cause beyond the reasonable control of the company , including war, insurrection, fire, flood, earthquake, strikes, lock-outs, or similar cause.
Save as provided above, we accept no liability arising out of the performance of the service, which is at all times the responsibility of the cabby and taxi/minicab company concerned.
The information in this website and associated mobile apps is supplied by the company and while we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or associated mobile apps or the information, products, services, or related graphics contained on the website or associated mobile apps for any purpose. Any reliance a customer places on such information is therefore strictly at their own risk.
Every effort is made to keep the application running. However, the company takes no responsibility for, and will not be liable for the website being unavailable due to technical issues beyond our control.
Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. By agreeing to these terms and conditions you acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Use of any services, information or materials on this website is entirely at the users own risk, for which we shall not be liable. It shall be the users own responsibility to ensure that any products, services or information available through this website meet their specific requirements.
Unauthorized use of this application may give rise to a claim for damages and/or be a criminal offence.
Your use of this application and any dispute arising out of such use of the website is subject to the laws of England, Scotland and Wales.
